*§ 1 Scope*
1.1 These Terms and Conditions ("T&C") apply to all brokerage contracts and services between Golden Door Immobilien GmbH, Mörfelder Landstraße 19, 60598 Frankfurt am Main ("GDI" or "we"), and its customers. Customers may be consumers or businesses. All terms apply equally to all genders.1.2 Deviating provisions or terms from the customer will only apply if GDI expressly and in writing acknowledges
§ 2 Commission Invoice*
2.1 In the case of a commissionable contract, only Golden Door Immobilien GmbH will issue a commission invoice. The customer can discharge the payment obligation only by paying GDI.
2.2 We reserve the right to send the commission invoice electronically, unless the customer expressly requests otherwise. This request must be made in writing before the invoice is issued.

§ 3 Confidentiality*
3.1 All information and documents provided by us are intended exclusively for the customer and may not be shared with third parties without our prior written consent.
3.2 Breaches of this confidentiality obligation will result in claims for damages. The customer is fully liable for any damages incurred.
§ 4 Liability*
4.1 The property information, documents, and plans provided by us originate from third parties (e.g., sellers or landlords). We do not assume any guarantee for the accuracy or completeness of this information.
4.2 The customer is responsible for verifying the accuracy and completeness of the provided information.
4.3 We are only liable in cases of intentional or grossly negligent breach of duty. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to typical, foreseeable damages. This does not apply to damages resulting from injury to life, body, or health.
§ 5 Consumer Dispute Resolution*
5.1 The European Commission provides a platform for online dispute resolution: [http://ec.europa.eu/consumers/odr/](http://ec.europa.eu/consumers/odr/). We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 6 Jurisdiction / Applicable Law*
6.1 If the customer is a merchant as defined in the German Commercial Code (HGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Frankfurt am Main.
6.2 All legal relationships between GDI and the customer are governed by German law. For consumers, this choice of law only applies to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the EU country or Switzerland in which the consumer has their habitual residence
§ 7 Severability Clause*
If any provision of these T&C is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The statutory provision shall apply in place of the invalid provision.
